In a car accident, is the party not at fault entitled to a rental car while their vehicle is repaired?

If you don't have rental on yours they should provide one for you but there is usually a limit as to what daily rate you can have and how long you can use the car. Make sure you can get one for as long as it takes. But one month seems a bit too long for any car to get repaired so you might want to check on why it will take so long. It should only take a few weeks at the most. You can also claim for injuries and have medial expenses paid for up to two years after the accident in case you start to experience difficulties later due to the accident but you should get checked for injuries right away because claiming later will be a weaker case. If yo! u are at all in pain get checked right away and keep up with a! ll documentation. Now every state has different laws so check the insurance laws in your state especially when it comes to claiming injuries because there are maximums of how much medical care you can receive before it has to be billed to your health insurance. If you decide to get an attorney make sure its a good one and make sure you keep up with everything they are doing or not doing and get a new one fast of they are incompetent. In your case where it's clearly the other drivers fault their insurance company should be rolling out the red carpet for you so make sure you get all that is due you. Thomas Riner: If you have not signed anything you have some leverage with the other parties insurance company. Call them and tell them your back hurts. Tell them you need a rental car. If they will not provide you a rental car call a lawyer. There are thousands of ambulanc! e chasing attorneys who would be glad to take on your case with no upfront fees. Betsey Copp: Sounds like he didn't have any insurance at the time of the accident. If he had insurance he wouldn't have to ! be putting up a security deposit. If he did have insurance but didn't have the proff of insurance card with him in the vehicle the law enforcement people will consider him not having insurance until he can prove he does and they may have required him to put up the security deposit. You are required by law to carry at the very least liability insurance on any vehicle you drive on the roadways. You are also required to carry the insurance card or paper in the vehicle at all times showing the vehicle as coverage on it. If your dad has insurance and he can prove he has insurance by getting a statement from his insurance company the law enforcement will give him back his security deposit. They may issue him a ticket for not having proff of insurance in the vehicle when they asked for it. If he didn't have insurance and the accident was his fault he will be paying out some big dollars. Hopefully no one was injured or killed in the accident because he will be sued most like! ly and will be paying for a long, long time.
